If Biden goes around the Senate with an executive agreement, which he will almost certainly do, could the states mount a response and refuse to implement the treaty or any edicts that flow from it? I know SCOTUS precedent would favor WHO and the administration, but maybe the states could challenge the treaty on constitutional grounds?
