I’ve had inquiries about the state of my prison case so I thought I’d share with you a copy of the appeal that my attorney filed on Monday.
This appeal is for a release from prison pending my MAIN APPEAL of my contempt of Congress conviction. In cases like mine where there are significant constitutional issues, a judge normally will release a defendant to allow the appeal process to take place. My judge chose not to do that so we are going first to the Appeals Court, and if necessary, the Supreme Court — nothing has really been normal about my case.
The appeal we filed focused on just SOME of the major constitutional issues raised by my case. It is a case that in all likelihood will be a landmark constitutional case on the constitutional separation of powers and the role of executive privilege in effective decision-making — President George Washington pioneered the use of executive privilege to stave off partisan attacks from Congress.

The District Court took issue with HOW President Trump invoked executive privilege, but the judge was essentially creating new law in doing so and admitted being in “uncharted waters” and “hamstringing my defense.” That’s grounds for appeal.
The Supreme Court and Department of Justice have zealously guarded executive privilege and have recognized it as essential to effective presidential decision-making. Ditto
The District Court in my case relied on “Licavoli,” an antiquated and misapplied alleged “precedent”; if overturned as it should be, my case would either be dismissed or I would be given a new trial.
